Let your insurance work on it.

I was rear ended several years ago and similar situation, cop came out but no police report just exchange info. I had a picture of our cars on site and a picture of his license. My insurance was going to pay anyway but his was saying they cannot reach him to get his side therefore they won’t pay. I filed a complaint with the state insurance regulator and his insurance paid the day they got it. Tried gaslighting me like oh we never said we weren’t going to pay. Ha!

The insurance won't figure out who was at fault. You will have to pay your deductible and it will be an accident on your insurance.

Similar incident happened to me, but on a three-lane road (Wisconsin Ave), not a highway. The other car just suddenly merged into my car. The driver claimed I’d merged over into his lane. I was livid, because not only had he endangered my kids, but then he had the audacity to flat out lie about it. When I spoke to the insurance agency I was adamant that he was lying and told them they needed to pursue this and not let him get away with it. I also added some details about the situation that lent support to my claim (I was taking my kid to preschool and needed to turn in a block, so it didn’t make sense that I’d be leaving my lane). I don’t know if that’s what did it, but the insurance companies found him at fault.

OP, what is the other driver’s story? Is he claiming you were changing lanes? Speeding up to prevent him from merging?


It’s actually a legitimate legal defense. If you can get out of the way, you should. Being “right” can cost you a lot of time and money.

That’s assuming that drivers who could have prevented accidents chose not to. I think most drivers don’t want to be involved in a collision.

No. I was driving in the right lane and he just started coming over into my lane. I was not attempting to switch lanes.


This precise thing happened to me years ago when I had a brand new audi. Had not even made first month's car payment on it when a woman in a huge mercedes SUV apparently decided she needed to exit two lanes over IMMEDIATELY and thought the quickest way there was directly through my car. Based on the damage, I immediately realized that she could just as easily have said I came into her lane - the damage to both cars was along the sides. Luckily she told the truth. But while I waited for her to get in touch with her insurance company for an entire week, the stress of it caused me to immediately order a dash cam. I now have had dash cams in all my and my wife's cars ever since. It's really not hard to install, you can do it yourself in about an hour tops


NP thinking about getting a dash cam- can you recommend one? Does not have to be high end with different functions, just something basic that will do the job.
