This is not true at all- both drivers broke the law, OP by failing to yeild and the other driving by speeding. The other driver’s speed would absolutely be considered in figuring out comparative fault.
That is not correct. If you are crossing lanes, you are required to yield. The speed of others is irrelevant. You did not yield to the vehicle that was legally in their lane.
