Probably, but that also means they don't need to offer him anything. Posters here may have fanciful ideas about jury nullification, but there's no way a jury doesn't convict on first degree murder here.

Are you willing to commit perjury to get on the jury in the first place? Because it will require that.

Eh, this is what I would call murder-lite.
Like when a parent kills the person who harmed their child. Murder-lite. Juries don't usually convict those parents and I'd be surprised if a jury convicts this guy. There are now people actively boycotting not only this specific McDonald's in Altoona but all McDonald's b/c that's who called in the tip. Freaking hilarious.
Also, the evidence has been collected/touched by another police force so that just doubled the chances that something was effed up. So many cases in my county get dismissed because of huge errors by the local police and sheriff's departments. Just absolute dumb errors that should never happen, like booking a suspect under the wrong name. But that's what happens when your "best and brightest" is mostly made up of HS and community college grads. C'est la vie!
