What's so great is that there are so many crooks, shady characters, and unregistered foreign agents in Trump's orbit,, we have no idea who is going to be indicted. The target list is ridiculously long!

Only Rosenstein can fire Muller. So Trump would have to fire Rosenstein and a few others under him, get them replaced and have the new people fire Muller.


I take this back. An AG who isn't recused on the subject could also fire Mueller. So if Trump fired Sessions and replaced him with someone else, that someone else could fire Mueller.


Trump would have to get Senate confirmation for that "someone else."

It is unknown if a president can pardon in cases of his own impeachment. The legal papers around Watergate suggest that is not allowed for a variety of reasons including the separation of powers (by pardoning, Congress wouldn't be able to litigate an impeachment)

So if Trump really wants to go through that and put the country through that, it would take years of litigation and the GOP would be completely shredded in the meantime.



Mueller is not impeaching Trump. He is investigating crime, and if those crimes involve the president, then it will be Congress's responsibility to respond, or the president could step down.


Or Trump could be charged once he leaves office.

Yes. In fact, he can issue pardons now for crimes they might have committed. But, there is a wrinkle. If you accept a pardon you are admitting you committed the crime for which you are being pardoned. And that can be used as evidence of guilt if you are tried by the state for a crime with all of some of the elements of the federal crime. . So you could actually end up in a worse situation, depending on what your federal crime is.

And realistically, if you care going to serve time, you want Club Fed, not the sate penitentiary.

So, the pardon can happen. But it might be a bad idea. If it were me, I would make the Feds convict me before I took a pardon and admitted guilt.

He probably could -- although the special counsel position was designed to not allow that. It would be insane for Trump to do it, although I don't know if he realizes that. It would be much worse than firing Comey, and that was very bad for Trump.


Trump can’t fire Mueller directly. He can order Rosenstain to fire Mueller, and fire him if he does not. But the Statute says Mueller can only be fired by Rosenstein, and only for cause, and in writing. If Mueller was fired. He could, and likely would, ask a Court to enjoin the firing as not for good cause. And Mueller would likely win. So the end result may well be that he cannot be fired.
