The Us has hired El salvador to imprison these people. They have every power to pull someone back. I guess you are saying Trump is too weak to do it.
The Us is not paying for his imprisonment. The US has a contract with ES for members of the Venezuelan Tren de Arugua gang - not El Salvador citizens deemed MS13.
But all of that totally misses the point!! So what if he’s a MS13 member?
Was just listening this morning to NPR and they were crystal about the real issue which is he didnt get due diligence.
Repeating it does not make it true. He had 2 hearings and lost both. Is that not due diligence? How many chances should he get?
It’s regurgitated talking points from people who aren’t following the case and simply have an anti Trump agenda.
Neither of the PP’s are correct.
He had a hearing and was granted a “withholding of removal”. That was the last hearing he had! Those words mean that there was a court order FORBIDDING the government from sending him to El Salvador. Let’s stop debating the eff up, as it’s already been admitted but the administration.
You can argue that it’s out of our hands now if you want, but that makes you an evil SOB.
Please tell us how to force his return if El Salvador says no. If El Salvador wanted him returned, he’d be here.
. Plenty of ways to persuade but in the end it IS there choice which is why we should never have sent ANYONE there. wtf are we doing by sending people to foreign prisons that don’t even meet the basic standards of international law???? What country is this??Anonymous wrote:Anonymous wrote:Anonymous wrote:Anonymous wrote:Anonymous wrote:Anonymous wrote:Anonymous wrote:Anonymous wrote:If El Salvador does not want to release their citizen, be mad at El Salvador. Wrong. He had a withholding from one specific country, and the deportation order from 2019 was still in place.

Actually, the opposite is true. You and the PP are regurgitating MAGA talking points.
Regardless of whether Garcia is a good or bad person, regardless of earlier court rulings, and regardless of whether you find him to be a sympathetic figure or not (most don't, including me), what you can't seem to grasp is that the most RECENT or LAST time he appeared before a judge was in October 2019 where the judge gave him "withholding of removal" status. Because he was sent to El Salvador despite the withholding of removal, on April 10, 2025, the U.S. Supreme Court unanimously ruled that the Trump administration must "facilitate" his release because he was unlawfully deported to El Salvador despite a prior court order prohibiting his removal. It's that simple.

2011–2019 (Ages 16–23): Lived in Maryland without legal status. Never filed for asylum during this entire period.
March 2019 (Age 23): Arrested in Maryland. Only then did he claim fear of gang persecution, citing threats to his family’s store—a claim not previously mentioned and for which there is no confirmation he was involved in the business at all.
2019: Asylum application denied due to being filed too late. Granted "withholding of removal," which is temporary protection—not legal status or a path to citizenship.
June 2019: Married a U.S. citizen shortly after legal options narrowed—raising concerns about the motive and timing.
March 2022: El Salvador began a nationwide gang crackdown under President Nayib Bukele. Over 85,000 suspected gang members arrested.
2024: El Salvador’s homicide rate dropped to 1.9 per 100,000, making it one of the safest countries in the region. The gang threat cited in his claim is no longer considered a valid basis for asylum.
January 20, 2025: President Trump signed Executive Order 14155 to suspend the U.S. Refugee Admissions Program (USRAP), effective January 27, 2025—halting refugee admissions and pausing pending cases.
March 12, 2025 (Age 29): Detained by ICE during a traffic stop and told his immigration status had changed.
March 15, 2025: Deported to El Salvador and imprisoned in the CECOT high-security facility.
April 10, 2025: U.S. Supreme Court ruled the deportation was illegal and ordered the administration to "facilitate" his return.
April 14, 2025: El Salvador’s President Nayib Bukele refused to return him, calling him a "terrorist" and asserting that his legal status is now up to El Salvador's laws.
He was old enough to claim asylum in 2011 but waited until after getting caught in 2019.
His persecution claim was based on an unverifiable threat to a business he may not have even been part of.
El Salvador is now safer, and the gang violence cited in his claim has been dismantled.

Because repeatedly beating up your wife is TOTALLY legal according to Democrats?
Human trafficking is totally legal according to Democrats?

Those hearings had nothing to do with his deportation pursuant to the Alien Enemy Act. since the administration chose to use that, they chose the rules. And the rules say he needed to have provided, minimum, notice and opportunity. The courts all agree. Up to and including the Supreme Court. And the administration agrees.
With respect to what the agreement with El Salvador covers, we do not know. No one has seen the agreement and all we have are vague statements from an administration who refuses to comply with discovery orders and generally is telling everyone and their uncle to FO.
