Congress could. If they won't, the courts can and will. In this country, our court system is the most powerful of the 3 branches. Project 2025 talks about overturning Marbury v Madison - but that's just talk and they cannot do it without a lot of consent from everyone else. Which they won't get.
Other countries may be set up differently. But this is how we are set up and it has worked well for us. We will find out soon if it will continue working well. Fwiw, I think it will, DH thinks it won't.
