OP here. When I started this thread I never guessed I would get so many responses. And I know I'm not the only one that feels this way. I know many parents from Capitol Hill to Georgetown who have the funds, and their kids the aptitude to go to any one of DC's privates and they feel shut out.

That's not quite true, now is it? Apparently, the kids DON'T have the apptitute to get in anywhere - after all, they were shut out. They only can get in anywhere if you artifically limit the applicant pool.

Seriously, this is just sour grapes.

really? a liberal thing? sounds more conservative, states rights and such, if dc wants to do it, why would you care? it is none of your business. you don't live in dc. that is unless you belief that people who live in one jurisdiction should tell people in another jurisdiction how they should live and what they should do? Sounds like you need a really big government to do that

That's not the one I'm thinking of, but similar concept. You're probably thinking about the 1990s case, but I was thinking about the 1970s case that said NJ can't prohibit Philadelphia from sending its garbage across the river. The bottom line is that one state (DC here) cannot set up discriminatory barriers to commerce with citizens of other states (MD & VA people who want to buy educational services from schools in DC). For that same reason, VA probably couldn't charge DC residents an extra surcharge for flying out of National Airport, to compensate Virginia for the extra state infrastructure required by those rotten DC carpetbaggers (carpet-flyers?).

All DC needs to do is to pass a law that says that "sure you can admit whomever you want, however if you admit more than 30% non District residents we don't consider you tax-exempt on the State level so pay property tax"

I remember the trash issue, the state or what ever government would not allow a company to dump anywhere but at their place. So, the county could charge $87 a ton at their dump and a private dump in another county or state would charge $30. ie you have to go here so I will charge you more. Court said the county could not restrict the private hauler. So, no one is telling where to go, just charging you more tax if you are out of state.

Aren't there a hundred or so court cases that prohibit one state from regulating commence in a way that discriminates against the citizens of other states? It's been more than a decade since I thought about this stuff, so maybe I'm getting it wrong, but I remember Supreme Court cases about milk and garbage imports. It seems like those cases would clearly prohibit what some people are suggesting here.

I gather from this thread that a simple response of "the Supreme Court says you simply can't do that" probably won't slow down the train. I'm more interested in whether I'm correct in my recollection of Constitutional law. Where are the lawyers when you need them?
