A lot of people don’t believe this was a death threat. Because of the historical meaning of “86,” there’s no way to prove that this was intended that way.
I think that a plausible argument could be made that he didn't mean it as a reference to murder. But I don't believe a democratic administration would give grace if the shoe were on the other foot. I think the person would be facing charges of terrorism, incitement of violence, etc.
