Jesse Furman from the Southern District of New York doesn't have jurisdiction to hear a habeas petition of someone being held in Louisiana.


Khalil's lawyers have evidence that the government transferred him to Louisiana AFTER the habeas petition was filed in New York.



Of course they moved him after the fact

They didn't even know he had a visa (dimwit, did DOGE fire the person who would've looked this up for them)

Now they know this guy has rights here so they try to shuffle him off to a Trump loving judge.

You say he’s deported for utilizing his free speech rights, and you’re wrong. He assaulted someone, that’s not free speech.


Who did he assault? When and how? And if so, why wasn't he charged with a crime?

I dunno what you're talking about, marriage-based green cards are typically sorted out in 14 to 24 months. It's definitely not "years". And it's not "the slightest whiff", as marriage to a US citizen typically clears away most things that would bar admission, for instance, working without permission.


Marriage based green cards start off as a conditional green card approval for two years. So you get to stay for two years. After two years you have to file to get conditions lifted and a permanent green card. To do that the couple still have to go to interview and show they have a real marriage. You see people stressing out over the smallest things at this point to ace this interview. No immigration officer is going to lift conditions on his conditional green card.


Yes, I was going to bring this up as my DH and I went through this process after we got married. They specifically ask on the petition to remove conditions if the applicant has ever been arrested, detained, indicted, charged, fined or imprisoned for breaking or violating any law or ordinance.....etc. They have to provide documentation related to the charges. This would make it easier because the authorities wouldn't have to revoke his Green Card, they would just let it expire without the conditions removed.

I haven't been following this closely so I really don't know what he did or didn't do, but to get involved in somethiing that could lead to arrest when you're on a conditional GC is not wise. As a PP said, we were also told that my DH shouldn't even get a traffic ticket while he was on conditional GC status!


Well, that's the issue here, I guess. The articles say he hasn't been charged with any crime.

So if all he did was ATTEND a protest (Constitutional Right to Assemble, right to free speech) - that is not illegal, right?

So why was he detained?

If the reason is "You aren't allowed to protest in defense of XYZ people..." that's really bad. That violates his right to free speech.

You probably won't understand, but it is a third grade civics issue.

We all learn (or we should) that first amendment rights must be protected, no matter what the person is saying or protesting.

That's why liberals will defend the right for horrible people (like Nazis) to assemble and parade.

That's not to say we will be happy about it, and we might boycott shops that cater to Nazis or even yell at them while they are having a parade. But we agree that they have a legal right to assemble and to not have their speech suppressed by the government.

We don't award first amendment rights only to some people (who love the right things). It has to apply to all people, and we need to protect that right.

If you didn't learn that in third grade social studies, please go back to school and learn why it is important.

According to above article

While U.S. law forbids anyone from providing “material support or resources” to terrorist organizations, a designation given to Hamas by the State Department in 1997, Khalil is not accused of doing that, and has not as yet been charged with any specific crime
