1. Trump will appeal to SCOTUS now
2. Lower court will stay the ruling until SCOTUS hears the case
3. SCOTUS will punt until after the election
4. Trump gets elected
5. SCOTUS indicates a sitting POTUS cannot be tried for this
The Federalist Society - sponsors of Justices Alito, Gorsuch, Kavanaugh, Barrett and Roberts, are done with Trump. They have backed Haley in 2024.
So no, SCOTUS will not let Trump off. The Justices can just let this stay at the DC Court and let Trump rot.
how do you figure that they are done with Trump? I could see Roberts and Barrett being done with him, but not the others.
They wouldn't be running Haley if they still supported him.
are you saying that they can influence some of the Justices? If so, that is hugely concerning.

I disagree. Trump would murder in a heartbeat. He's already bragged that he could murder someone on 5th avenue and nothing would happen. He would murder Biden because Biden had the audacity to "steal" trump's election. If he is reelected Trump will have his own police force, the new SS and Gestapo. He will find a way to find out how every American voted and those who voted against him will be political prisoners in Trump's re-education camps. You think this is crazy and extreme.
"When someone tells you who they are, LISTEN!"
He already controls the GOP members of the Senate and House. He controls the Supreme Court who will agree that he has immunity for life!

But if we now say a president can be tried criminally once they have left office for actions taken while in office, why not have that apply to all prior presidents. That would be interesting to see.
What other presidents in recent memory besides Richard Nixon and Trump have done prosecutable things while in office?
I recall a certain president perjured himself and was disbarred. Perjury is a crime.
How often is perjury prosecuted? And perjury relating to a personal fling, not national security or matters of grave national importance?
Baltimore DA just got convicted of perjury for some minor false information on applications and currently awaiting sentencing.

There are 2-3 conservative justices who could go either way. Praying they do the right thing and stand up for the rule of law.
I don’t see why they would even entertain this argument. I expect them to deny cert.

+1
“At bottom, former President Trump’s stance would collapse our system of separated powers by placing the President beyond the reach of all three Branches. Presidential immunity against federal indictment would mean that, as to the President, the Congress could not legislate, the Executive could not prosecute and the Judiciary could not review. We cannot accept that the office of the Presidency places its former occupants above the law for all time thereafter. Careful evaluation of these concerns leads us to conclude that there is no functional justification for immunizing former Presidents from federal prosecution in general or for immunizing former President Trump from the specific charges in the Indictment. In so holding, we act, “not in derogation of the separation of powers, but to maintain their proper balance.”
