I was was able to watch it and wow! Unbelievable what she did. It’s child endangerment. After watching the video I 100% believe she crashed into the skier because she wasn’t looking.

I think in that scenario, Paltrow can't settle herself without risking losing her insurance. If the insurance company thinks this is just a rip-off law suit and Paltrow has no liability and/or thinks the amount plaintiff has asked for is unreasonable, it could be that the insurance company is driving this to go to trial, not Paltrow.
If she settles to make this go away, I think she may risk having the insurance company drop her. It may feel that caving into a lawsuit like this will make it more likely that someone else will sue her for a larger amount.

He refuses to settle, she can't settle it on her own as the defendant. She is countersuing for $1 to make a point. He sued for 3 million, the judge knocked it down to 300k. This is not PR for her, you can tell she doesn't want to be there.
