The vote by the Senate is performative because they have the constitutional right to overrule DC laws- but if DC withdraws the laws from consideration then there is no reason for the Senate to vote on it, other than to have a vote on the record about how members feel about the legislation. Therefore it is performative- it serves no actual oversight purpose.
(I do agree that Mendo might not have the unilateral right to withdraw legislation but Shumer declaring already that they will vote on it without giving the full council the right to withdraw it is, again, performative. He is putting on a performance for his constituents who believe the Fox News talking points about the bill).
(and for the record I don't love most of the crime bill but the talking points are completely disingenuous)
