The onus is ALWAYS on the driver in the U.S. in general and the law is on the books in Minnesota. He, on foot, can walk anywhere he wants, even stand in the middle of the street and motorists must yield. You cannot use a vehicle as a weapon to harm a human body, even if you’re upset/overwhelmed or feel righteously justified. If there is a physical confrontation or contact, the driver has very little, if any, defense. And, this is inconvenient for those who want to ignore it, as a federal agent, he has the right to move about the scene and order/make interlopers leave. Even if he says so “rudely”, as someone earlier whined. Even if “legal observers” don’t like his job or the agency he serves.

The “elite training” is mostly three weeks of calisthenics to beef up the muscle on these thugs. They are being trained to assist others as the muscle, not to operate independently and make their own decisions.

I’m a licensed attorney who practiced for years as a criminal attorney, half a dozen as a prosecutor. I feel entirely comfortable critiquing this agent’s actions- actions which are in direct violation of DHS policy and the training he’s undoubtedly been provided probably multiple times since he was involved very recently in legal actions for another violation of department protocols regarding engagement with individuals in vehicles. He was ENTIRELY UNJUSTIFIED in his use of deadly force, and I would expect him to be convicted by a state or federal jury on charges of murder, if such charges are brought. If they aren’t it will only be because this administration is corrupt and engages in coverups of illegality by the day.
