And it makes even less sense given how close we are to the election.
Clayton has been vetted and the senate can probably move reasonably quickly, but it seems silly and McConnell probably doesn’t want to have to make this a priority over getting judges confirmed, which will have a much longer lasting impact.
Clayton has been blue slipped by both NY Senators. He isn’t going anywhere. Now, neither is any other Trump pick.
Blue slipping isn't a thing anymore. McConnell killed it.

McConnell can ignore the blue slip, but I’m not sure he will bother here.

Is SDNY investigating something that concerns Barr?

You obviously haven't been paying attention to his Senate campaign. Trump is supporting his opponent, so Sessions is simultaneously trying to be loyal to Trump while encouraging voters to go against Trump's endorsement of his opponent. It is delightful.

Except when their "acting" terms is extended by the Court. The law is fairly plain in stating that the court appointed replacement is only superseded by a Senate confirmed replacement.
Do you mean activist judges like Sullivan?
You don't think Roberts was activist in Heller? I have some news for you...

Anonymous wrote:Clayton must regret this. He presumably had no idea that Berman’s exit would play out as it had.
He’s been one of the few Trump officials whose reputation is still fully in tact. He’s not responsible for Berman being pushed out before his confirmation, but I’m sure the stink of this will rub off.
I wonder if he pulls his name, especially with Graham’s statement calling into question whether the Senate will move forward with the nomination given how this was done.
