Well. if you read that article, Flores says he refused to go along with the plan "and that was the reason I was let go."
So he just gave a completely non-racial explanation for why he was let go.
I don't see how this allegation helps his racial discrimination case at all, and in fact, if true, it shows he was fired for completely non-racial reasons.
It will be a major embarrassment to Ross however, and maybe the is the whole point. Revenge.

This is where it is important to distinguish between disparate treatment and disparate impact. Many posters in this discussion (not necessarily you, pp) are completely tunnel visioned on disparate treatment, as if that’s the only potential theory of liability here. A disparate impact claim does not require proof of intent to discriminate, only that the policies and practices in place have the effect of discriminating against minority candidates. The theory requires a very different kind of proof than a disparate treatment claim, and is much more likely to result in class certification because it does not require the same kind of individualized proof that a disparate treatment claim does.

Not necessarily. Tanking a season like Ross asked Flores to do would have destroyed Flores’ career. When you consider it from that perspective, $100k per game was a pittance. Would he have asked a white coach tod on the same, or did he only think a black coach would be such a fool as to take that deal? Did he take Floes serious as a head coach, or was Flores a patsy to get a couple years of good draft picks and then was going to fired in favor of a “real” head coach?

Unless you are Stephen Ross or someone very close to him, you do not know the answer to that any more than I do so don’t bother trying to pretend you do. But if there are written records (texts, emails, etc.) or anyone who is will to speak up and admit they had discussions with Ross about this stuff, it could get ugly.


It is a good question, and I think the answer is Yes, he would have in that same situation. But that is speculation, since we will never know.


NP but it's important to remember, even in this imaginary scenario, that taking money to tank would be a different calculation for a white coach. There is plenty of statistical evidence that white coaches get second and third chances after losing seasons, while black coaches do not. So the white coach wouldn't be risking as much if they went along with the scheme because they can have losing seasons on their records without it tarnishing their credentials, while Flores actually had two winning seasons in a row (with a godawful franchise) and STILL got fired.

The Giants hired a new GM from the Bills. He was always going to take Daboll with him if he could.

And I think what the PP is saying is that the motion that people will stop watching the NFL en masse because of racial disparities in the coaching ranks is far-fetched, to say the least.


There is actually research out there showing that there was a decrease during the Colin Kapernick stuff. Future NFL customers are people of color - they will lose in the end if they don't get this together.
