Three of the justices are totally and completely illegitimate, that’s how. The GOP just does what it wants, and no I don’t know why. I guess Democrats are just fundamentally decent people who believe in the rule of law and won’t take the motherkillers down, but here we are.
Sorry I don’t mean “how” literally. I mean I would like someone to explain the logic to me because in my reading of the opinion I’m not finding any.
They don’t need any. Now do you get it? When people have been warning that the GOP wants a religious dictatorship or a theocracy or a fascist dictatorship, did you not understand that they meant it? There doesn’t have to be any logic. For the GOP there is no rule of law anymore. Anything goes; they clearly don’t have to have any reason for anything.

Under their interpretation of the Constitution power flows down instead of up. Rights are not inherent to individuals but rather courtesies given to the people by the government.

I never thought this way before, but I am beginning to think that this massive nation with 50 states that can rule any way they want on important issues like abortion, the death penalty, access to healthcare, etc. is simply not workable. How can it be possible to have--in one nation--such a wide range of state laws on an important issue like abortion where you have on the one hand states that permit late-term abortions (e.g OR) and, on the other hand, states where it is illegal to have an abortion after 6wks (TX, OK). If we left everything up to the states, we'd still have unequal protection under the law in many states for all sorts of categories of people like women, racial/ethnic minorities, sexual minorities, etc.

It doesn’t work. That’s why we have the 14th amendment and al of the jurisprudence coming out of it. It’s why we had a civil war.

I’m aware of the 14th thanks. I was responding to PPs who didn’t understand that the constitution gives powers not specifically excluded to the states. Subject to the other provisions of the constitution of course, and therein lies the issue.

Other than trolls who thinks it should be abolished? In a sane world, in a democracy, the three Trump joke justices (plus the insurrectionist Thomas) would be out. All three of them perjured themselves. I remember the mother effing sht storm around the word “is” in the late 1990s and how the GOP just about collectively popped an aneurysm over it. I know it was largely show among the losers like Kavanaugh, but every day GOP voters really did think that was the end of the world.
Here, three bought and paid for justices perjured themselves. Roberts doesn’t care. Here is judicial activism by five justices being led around by their disgusting religious impulses and misogyny. Roberts doesn’t care. The court is illegitimate.

Read the Ninth and Fourteenth. States are limited by the Constitution. The 14th Amendment was a Second Founding. Its purpose is to restrict states.
