That sounds odd, OP... wouldn't there be a closing where the deed is exchanged for the cash? Don't do anything until your attorney has adequately explained.

No, it’s not normal. Your attorney should update you about what is going on in plain English. Why aren’t they?

Sure. There is plenty of ways for the deal to blow up. Do you mean a quiet title action. A quit claim deed is basically a deed that only guarantees the current transaction is valid and don't know the validity of whether any prior conveyance were accurate. This is opposed to a warranty or special warranty deed.

Further, some type of deed is going to need to be executed and filed with land records. You may have an agreement but that doesn't constitute a deed transferring the property.

Lastly, why are you asking an anonymous board for legal advice. Talk with your attorney.

Your parents should have indicated what their intentions were with this house in their will. Evidently they didn’t.

What? No. It sounds like once OP's side forced the issue with a partition, House Sibling finally acknowledged the estate's position was the correct one legally and that they've been unreasonable all along. Had they had a strong case, House Sibling would not have settled quickly.

House sibling really tried to screw the rest of them. So glad you all didn’t cave.

Thanks all. The partition got things started. It takes time since the estate and house aren't in same jurisdiction. Then it went silent for months. No idea what was going on. Then just an email with signed agreement from 2018. It was the only agreement ever drawn up. Back when we thought this would be easy. There were plenty of emails from House Sibling making various demands, including a letter from lawyer saying it was parent's desire and their understanding that entire estate was to go to House Sibling alone. Crazy town.

The divorce filings are all from same marriage and the filing is done by same spouse. Maybe the lawyers know more or private school parents. The filings are always done between now and early Feb. They have multiple kids in private school. Do you think it has something to do with tuition? Or applying places?

So far they have withdrawn each of them.

Wow, congrats OP! I’m so happy to get this update. Have House Sibling’s divorce filings been from 4 different spouses or multiple filings re the same spouse? Either way, no wonder they made things so difficult for you and the other siblings with that history.

OP here with an update-- we have a signed agreement! House Sibling agreed to the very first offer which was made years ago where they get house and the rest split the cash.

We weren't sure what the trigger was for signing, but I do spend time checking the court records in House Siblings home county (lien paranoia) and see that House sibling filed for divorce, again. That will make 4 filings for divorce over the last 6 years.
