Her ratings are not all that great, according to Healthgrades:

Can y'all at least get the acronym right? Health Insurance Portability and Accountability Act of 1996 (HIPAA).

It really doesn't matter if she's a nice person and good doctor or your good friend, what matters is that it was unethical for her to steal the list of contact information and use it for marketing purposes at her new company.

I would have given her the benefit of the doubt if she was switching practices and sent her new contact info to her existing patients, but that's not what happened, and what she did is unethical and unprofessional. There is no benefit of doubt to be given here.

It literally says in the letter that is what happened. And to the person who said I am a (ridiculous term) Republican- no. I am neither. And now that people are on this thread, having no idea what happened or any connection to this situation, it’s worthless. It was a good run for many pages. I’m impressed we got this far before it went downhill.

The letter did not disclose the terms of her agreement or if she breached their agreement. If that had happened the letter would have been clear that the practice was taking legal action versus a mealy mouthed reference to HIPAA.

The practice cannot give her permission to violate HIPPA. It is a Federal law.

She should send out a letter to clients *before* she leaves, telling them where she is going.

Also, *her* clients, not the whole practice’s list.

There are ways to do this properly. Stealing data is not it.

It’s unethical for a partner in a business to send out info directing clients to another business while you’re still a partner at the first business. This is always done AFTER the move.

Also, if she was a partner (aka owner) she has every right to take client contact information. You people whining about this, don’t know anything.

This seems like an attack from some disgruntled former colleagues at Foxhall. if she was a founding partner of the practice, she may have rights to the client list. We don't know what her agreement was with the practice.

So she’s got friends and supporters on this thread now. Got it. The facts are the facts. If you got the letter, it is clear she violated HIPAA. Whether it was a little or a lot of information, it was a breach.

You sound a bit unhinged. I have never heard of this woman or used Foxhall practice but this entire thread has a onesided axe grinding quality that made me automatically question the narrative being put forth.

I've got no dog in this fight but you clearly are trying to shut this down. What she did was horrible and there will be repercussions.

Exactly.

I’m not too worried about it.

Anonymous wrote:First I was infuriated to learn today that an OBGYN at Foxhall whom I had never seen, stole a list of patients ( me included) , and their insurance providers and emails. Or as the letter that went out by hard cover to patients of the practice said " she retained a list"...then she gave the list to her new employer ( Alloy-where she is medical director) to use for marketing!

um....That is theft of IP.

Then I learn she is married to the former attorney general, Eric Holder.

Why hasn't she been fired from her current employer?

Did anyone else get this letter? It's very careful not to note the number of records..

She even has an endorsement quote from Michele Obama on her site...

Completely shocking and unbecoming.

I don’t understand why there is any murkiness to that conclusion and why this means that previous posters are “unhinged.”

I support the Democrats, but certainly think this should be a discussion grounded in facts. Just because you disagree with someone presenting facts doesn’t mean they are unhinged. Isn’t that the Republicans’ stock response about Cassidy Hutchinson and her January 6-related testimony?

This.

I agree this was a Hipaa violation (and the PP’s explanation above is a great one to show we should all care about any hipaa violation), but I assume my info never made its way to Alloy or I would have gotten the emails others here have referenced. So while this was a mistake (I am not going to assume intent), for me this one thing doesn’t erase the over 20 years of excellent, individualized care I received from her. I suggest that rather than rake someone through the mud publically, people affected who feel wronged should start by contacting Foxhall, because their internal procedures also are at fault here.

This. She is a great OB, while I had her years ago (over 17) if she would have moved at the time I would have greatly appreciated knowing where she was , as I would have 100% switched to stay with her services. Very compassionate and knowledgeable about her craft.

Let’s be clear: the Alloy email, which I received, was not informing former patients how to follow dr Malone. It was offering to sell you “bio identical plant based hormones” “right to your door.” The kind of medical online presence most DCUM would scoff at. But somehow some want to give her a pass.

The use of the emails was HER violation.
