He doesn't think it's a sham, it's the exact opposite. He knows they have him dead to rights and the only thing putting up a defense will do is open him up to more trouble in the form of perjury charges and whatnot.

The big talk is just for the rubes who actually do think it's a sham. When it really matters, he does what is best for Bannon, namely accept the inevitable and hope for the lightest sentence possible.

He's been charged with 2 counts of contempt, each one carrying up to a year in jail. If he's guilty of both, he should get at least a year.
