After 1/3 out and full tab on any medical expenses it may not be worth it to you. I got a $15k judgement in favor. Attorney took $5k. Physical therapy company and medical took $7k!!!!

Even though I had initially paid only copays. They attached to the claim. I got $3k! Just calculating that for you to drive home the point that in the end it may not be worth your time (lots of it).


In a contingency case, the lawyer takes 1/3 of the settlement, no matter how it's reached - they take a risk on doing the work for no billable fee, so you lose a substantial portion of your winnings/settlement to compensate them for their time/work. It's generally in the lawyer's interest to settle as it's less work for them and they get paid their 1/3 whether they settle or litigation, and litigation is expensive.
