In MD, nobody HAS to go to kindergarten to go to 1at grade. If you red shirt youre child, you just have the center sign the form that MD has that the code is in fulltime care with you. And that's it. Now, a redshirted child does go to kindergarten the next year. But due to the pandemic, we had a june kid stay is at our fulltime program rather than do distance learning kindergarten. The child will go to 1st grade in september. She's ready.

Whole Kids Academy is a Spanish immersion preschool and had a wonderful K program this year due to the pandemic. They are continuing next year also with it, I highly recommend. DD went there for preschool and now K and is learning to read and write in Spanish and english

If schools are not back in session next year and try to enforce those requirements against kindergarteners in a full time program, they can frankly shove it. No way would I pull my child out of full time in person so they can do DL or hybrid.
