This is a rookie nanny mistake.

You guys agreed on a rate, and she misunderstood it. You can try to renegotiate, but only if you really want to keep her. Tell her that her tax responsibility is 100% her own, and you’ll only talk about gross wages.

There are zero circumstances where a 1099 is legal for a nanny.

I agree with you, especially after a protracted argument with the IRS and submitting SS-8. I was unaware that they’d planned on giving me the 1099, especially since they had withheld fica (not taxes). If a nanny had NOT been audited after submitting a 1099, they might not be aware.
