There are zero circumstances where a 1099 is legal for a nanny.
I agree with you, especially after a protracted argument with the IRS and submitting SS-8. I was unaware that they’d planned on giving me the 1099, especially since they had withheld fica (not taxes). If a nanny had NOT been audited after submitting a 1099, they might not be aware.
