Yes, an employee can decide not to hire based on marijuana usage, state condoned or not. This has come up in Colorado numerous times. You may not use marijuana while working for Air Canada, though it is legal for adults in Canada. The DC government will not allow employees to have active medical marijuana prescriptions, even though there is no evidence that when used at home it is any more impairing than moderate alcohol use. Essentially, drug users are not a protected class.


If you are an employee of the state of MD, even though it is legal for medicinal, you are not allowed to use it and they do drug test.

Schools received federal funds. Most teachers also got some federal student aid, which they may be in repayment for.
