Yes, an employee can decide not to hire based on marijuana usage, state condoned or not. This has come up in Colorado numerous times. You may not use marijuana while working for Air Canada, though it is legal for adults in Canada. The DC government will not allow employees to have active medical marijuana prescriptions, even though there is no evidence that when used at home it is any more impairing than moderate alcohol use. Essentially, drug users are not a protected class.
