No you are not supposed to do that.

Child support is meant to help you with a portion of the cost of raising a child. There is an expectation that you too will contribute to these costs and child related costs do not have to be covered 100% by your spouse.

It is also not meant to 100% replace or cover all costs related to your household.


Well I was not legal to work up until last month. He gave me a "budget" and I could do nothing, ok? But at least he paid for the apartment. Now he wants to move out. As I said I have a job lined up but only a job I could get with a several years' gap in employment and within a month or so of looking for a job.

The child support is only supposed to be used to meet the child's needs, not yours. Stop paying the rent or the mortgage or whatever...file and get the right amount of child support. By the time they foreclose or finish the eviction the child support order will be in place and you'll have a job lined up to support yourself.


My credit score will be ruined though.

No you are not supposed to do that.

OP, visa issues aside, the short answer is no. You will not qualify for assistance if you end your ex have an informal agreement that allows him to pay less than the guidelines. You will have to get a court order regarding custody, child support and alimony (if applicable). No getting around it. And based on your ex's income, I highly, highly doubt you would qualify for any assistance for your children, because both parents income is taken into account. I don't think you understand how low income levels have to be to qualify.

In short, you need to file for legal separation, through the courts.

I mean, holy shit lady, do you think the taxpayers should have to subsidize you and your child instead of your husband when you are voluntarily accepting less support than the guidelines provide? And, just so you know, the idea for this "scheme" of yours has been around for a while except the people that do it are predominately poor and it is a way they try to hide income.


Look, I would gladly rip him off for all the abuse and suffering I endured for the sake of our child.
But, I don't want him to just run off to a part of the world which would not honor a child support agreement from the US. And if he has to pay what he is entitled to, he may well do that.

You really need to research the income limits to be eligible for government benefits. I’m not sure why you think you would be entitled to government support if you are working and your ex is providing $1200 a month in child support.

You won’t get the assistance. That is what people are saying about you being a visa holder. You are not eligible for it. Use your H4 and get a job. Your wages and the $1200 should be sufficient until you can get a court order for more CS.

What about after the green card?
You should really get some legal advice. Your H4 and greencard are tied to your husband. Divorce him and you won’t have either unless you get a new sponsor.
