Actually the statistic is 10% for those who seek a DNA confirmation. That's people who already have some doubts. It'll be far less for the population as a whole.

One of the reasons that folks think it is so high is because of genetic sequencing that became available in the 90s. Researchers took that data and found that 10-30% of the results showed that husbands weren't the fathers of their wives' children. But that data was not from random samples -- it came from men who had strong enough suspicions about the paternity that they decided to get a DNA test done.

Studies without that bias in data samples shows something more like 1%.

The ass whipping that woild follow this discovery would be earth rending and epic.

I don't see how it's about stupid or smart. Babies look like babies. Absent an obvious racial difference, you're not going to see strong family resemblance until later in most cases. Also, family resemblance is not always obvious. My daughter is definitely, 100% her father's daughter, but they look nothing alike. They don't have the same eyes, nose, lips, face shape, hair color, hair texture, etc. and though both both of them are white and Northern European looking, that's where the resemblance ends.

As for why it's still an issue with DNA, I would imagine that they don't think they need to do a DNA test, because usually men don't suspect that their spouse is carrying a child they didn't father.

You can DNA anyone, we did this to a friend's step child. There are great labs all over that sell dna kits, helpful so you know before going to court.
