Well, he's not in the UK NOW so the courts won't really care about what he MIGHT do in the future. You'll probably get a standard custody and visitation schedule with him seeing the kids every other weekend and some weeknights, alternating holidays, and splitting the summer.

LATER if he decides to move and you all go back to court to revisit the agreement, the burden of cost of the kids travelling to and from the UK to visit him will most likely be on him and you'll have to give up time in the summer but you'll still probably have joint legal.

Almost nil especially if he stays in the US -- unless he's doing things like using heroin when the kids are in the house.

My best friend did this (she's a lawyer, actually). She did not pursue child support in the hopes of keeping the divorce amicable, which has worked so far. Her English ex now lives mostly in the U.S., but prior to that, he would come visit for a week or two at a time every so often.

50/50 physical custody will be impossible if he returns to the UK, but PP is right that you might lose summers and every other Christmas or something.

I understand how hurt you must be (really) due to the cheating, but if he's a decent father, then those summers will probably do good things for the kids culturally and emotionally.
