Must be the other way around. 3.5 year old's parent got a ticket because kid was NOT in 5 pt harness.

Can I just say that we should all band together to resist the peer pressure among kids to get out of car seats and boosters? My 8 year old insists she's the only one still in a booster. I keep saying I don't care, but really, people, unless your 8 year old is a future nba/wnba player, they should have the booster. Mine is 75% for height and still no where near what the guidelines say for rising without a booster.

5 point harness carseats are the law until they are tall enough/heavy enough for a booster seat. A 3.5 year old should be in a 5 point harness.

I am considering it. The bad thing is that there are a lot of kids in her class out of seats that shouldn't be. I have to keep explaining to her that I am her parent and I decide for her. What other parents do is not important to me (even though I am secretly judging if you aren't using a booster if your kid isn't tall enough yet)

Yes, it's about improper use. If your child can sit in a backless booster without messing with the seat belt or slumping over, then they can properly use the seat.

The Car Seat Lady, who posted this, says that she should've been in a different seat BUT that even in the backless, she would've been much safer had she had the shoulder belt across her chest where it belonged.

After a certain age/height, the risk of the kind of injury this child had, particularly if the shoulder belt is used properly, is greatly reduced in all but the worst crashes.

Children under four not only don't sit right, their heads are still relatively heavy compared with their necks. If your ten year old is using the seat belt properly, she should be as safe as you would normally want.

Yes, I had a friend with horrific bruising and a couple of broken ribs when I was a kid. You know what else she had though? A full recovery. She is now the mom of two teenagers. Not exactly the same as suffering internal decapitation without the belt.

I've got an almost 10 year old who is small and she still sits in a booster. We probably had her in a 5 point until she was almost 9, when we relented and let her move to a booster. We fight over the use of the high back, because of the way it positions the shoulder strap. Well, I think we may be revisiting the discussion this year. I have to admit I've been letting her ride in a backless one since I had to take it out, back and all, to let someone ride in my back seat and I couldn't get the back back on very easily. Hmmm.

Yes, she was in the wrong seat but the warning stands for any child (and adult) who pushes the shoulder belt behind them. Don't put your kids in a booster seat if they're not mature enough to sit in it properly.
