If you are in pain enough now to go to the doctor, why didn't you do it sooner? I can see why the insurance company would questions your medical bills.

As others have said, if you went a few months without any medical treatment, certainly your claim that you were injured in the accident is going to come under scrutiny. As for suing, I can think of only one court in this area where you would even have a prayer of a chance at winning a lawsuit - and even then I doubt it. Also would be surprised if you found an attorney to take the case. People who are legitimately hurt in an accident just don't wait a few months to get treatment. Besides, even without treatment most sprains and strains are going to heal within a few months.

So long as its documented in your medical records that the visit/treatment is related to the crash, you can submit it. A couple of months is not that long at all. Back pain from that level of impact will linger

+1000. If you wait, you lose any opportunity of settlement with the insurance company on the other side, or, if you actually get to a jury trial, the delay will be used to show that you are lying or a malingerer, etc.
