A nursing home is different than a assisted living facility. There are not "transportations" to anywhere int he community from a nursing home, unless it is to the hospital.

OP, they can only look back at the last 5 years for the gifted money. So, if she gifts now and goes into care after turning 75y., they cannot get the money back.

Also, the maximum allowed gift right now is 5 millions per life. Just talk to a lawyer.

Are you sure medicaid facilities are all bad? I visited a relative in another state and his facility looked great. And he didn't have to pay for it.

We should make them terrible so people like OP won't consider this option.

Let's be clear, OP - you aren't talking about "protecting her assets," but rather "makign sure you, your sister and your families get the assets, and leaving the taxpayers foot the bill for your mother's care."

to be clear, EVERYTHING govt run is substandard. interesting how everyone is against govt assistance regarding this issue but not regarding everything else.

Sorry for the HUGE misinformation above (I said its been years and I'm not a elder law attorney). Just disregard it all.

It's that a transfer will result in a period of disqualification for Medicaid. So, if you transfer x amount of money, you cannot apply for Medicaid for Y period of time.

It's very complex. You should call an elder care attorney who specializes in Medicaid.

It has been a decade since I've looked at Medicaid issues, but I think any gift given within five years of going on Medicaid can be reversed. So even if she tried to give you the assets Medicaid would attach your property to collect.

Why should ANYONE other than your mom or you (since you are perfectly able) pay for her care??? Oh, because you want to pocket the money and have someone else pay your bills? Who do you think should foot the bill? The nursing home, the taxpayers, next door neighbor? This is entitlement beyond compare.
