So if people take them early as in now, but they later "find" the money or make cuts in other ways, and the # of days go away or are reduced, are the people who already took them SOL or will they get paid?
That's what my EPA friend said. Not much incentive to take them early.

EPA is supposed to be 4 days before June 1st, with up to 13 total for the fiscal year. We can take them as we please, in hour increments, as negotiated with our managers. But that's as of now, it might change.

Oops, just realized that I meant CR levels are FY2012, higher than agencies were asked to budget for FY2013.

Some agencies are better off under the CR because the CR spending levels are essentially FY2011 rates, which are slightly higher than the cuts agencies were asked to implement for FY2012. The CR rates also could include anomalies which allow more spending than budgeted.
As for the furloughs, DOJ at least was sending 30-day notices mid- to late February, so furloughs can happen any time. I don't personally know anyone who has had a furlough day yet, but it is certainly possible. Given that there appears to be no discussion at all happening about changing the sequester, I think it's more likely than not that someone somewhere will have a furlough day soon if it hasn't happened already.

Maybe their agency isn't unionized. Isn't the 30-day notice a union requirement?

Not naming names, but at my agency we are each getting a handful of days but we get to pick when we take them. I negotiated mine with my manager this week.
