Custody cases must be resolved in the country where the child lives.
And your home country would be obligated to return the child.
You must get custody. Then if you are deported, you are deported with the child. Is the fathers name on the birth certificate? If it is not, you have no problem. If paternity has been established, he must pay child support and has a legal right to see his child.
Whatever you do, do not put yourself in more danger by marrying him. Do not listen to the crazies on this forum who tell you are a bad mother for leaving your kid. You first have to save yourself.
The man sounds like an asshole and those familiar with domestic violence know what signs to look for.
So find the social workkers and other professionals who will help you get your child bck. By default they are on the childs side, not anyone else.
