OP here again. DH and I went to the initial court date and denied the claim of the service company and asked for a bill of particulars. We received it and the basis of their claim is that the contract is with DH and them. On the contract, my FIL's name appears as client and as payor. DH is listed as POA and signed the contract as POA. We have to provide our defense next week and I'd like to include the Virginia statute that states the agent isn't liable for the debts of the principal. But, I can't find it. I'm hoping someone familiar with Virginia Code/Law can help me. I found where it was prior to October 1, 2012 but that section was rescinded and I can't find anything in the current code http://lis.virginia.gov/cgi-bin/legp604.exe?000+cod+TOC64020000016000000000000 . OP here. Thanks for the responses, especially 18:54 (I know it wasn't legal advice ). The claim is $24,999 plus attorney fees so we're definitely not going to settle. Even at $250/hr, we can by a lot of attorney time for that. I'll write up a response, organize/index all the papers we have and then see an attorney. With any luck, the attorney won't have to do so much work and will save us money.

OP you could try Fairfax atty Kevin Wheatley 703-426-4320 - does some civil defense on behalf of creditors. Successful at getting a lot of those cases dismissed on basis that there was no proof of the debt. Creditors do a lot of threatening, but are frequently very sloppy about getting the proof they need to win a contested case. Atty will give you a fair assessment of your options and costs of going to trial.

OP doesn't really need a shark here, just a good, solid straight shooting advocate who will give OP good representation without gouging, and I hope, let the service company that they're coming at them hard and won't roll over (sharkiness not necessarily needed, but can be used if necessary). ;-o

When my mom's cousin died deep in debt, debt collectors starting calling her and wanting her to give information as to where his surviving brother lived.

OP, I'm so sorry for the stress this must be giving you. I don't know any good lawyers but I would get a different one than the last one. You need a shark. GL.
