Actually it does. Her child's father is being difficult - he is not forbidden her to travel with the child, just being difficult for the sake of it. He moved across the country and has little contact with the child - there is not custody agreement in place, so this definitely belongs in the courts. OP has to get the custody thing straighted out to begin with, and while at it, ask the judge for the travel authorization. I hope she gets full custody so she doesn't have to deal with this crap for the next 18 years.

You cannot legally take your son out of the country without his father's consent. Realize that you may get rejected and fly back at your own expense. Italy, being a conservative country, will likely give you a hard time. they will want to know why you have different last names, why you weren't married to his father, and then probably ask for the note. If you were to go to Amsterdam they probably wouldn't care. FYI
His father never opposed to the journey...He just wants to be an jerk...I'm pretty sure I have made it clear through my previous posts that my ex is just trying to be difficult. He helped me get his passport about 4 months ago ( before he disappeared)for crying out loud! I made an appointment with my attorney and I'm taking this matter to the courts where it belongs. thank you to all those who helped me in making this decision.
