You don't have to go anywhere. He has to serve a 5 day pay or quit notice first. Then you get a court date - at least 30'days out. If you pay he has to find another reason to evict, which takes 30'days nOtice.

Landlord here. If there's a grace period in the lease, then the landlord (and you) has no business complaining about it arriving by midnight on the 5th. If the landlord can't afford a grace period, the landlord shouldn't put it in the lease. There is no one holding a gun to his/her head forcing them to put this in the lease. Which is the same thing I say when anyone acts all moralistic about me not paying my mortgage before the grace period is up.
