If you want smooth concrete then they have to be scraped up and the mastic removed. Most any contractor can do that. They just spray them with water to keep down the dust and wear dust masks.

If you want the whole production with the plastic curtains, air filters and monitors and guys wearing silly looking hazmat suits, you will pay for that show to accomplish the same thing.

We had two layers of flooring under the vinyl the previous owners put down. We had it tested before a remodel, and one kind of flooring did have asbestos, but the other one and both mastics were asbestos-free.

I would not assume anything

As it happens, we had two layers of asbestos tiles in our basement removed this week. NOVA Environmental did our asbestos testing, and Young Environmental did the asbestos remediation. Highly recommend both companies. We live in NOVA, but I imagine they would work in DC and/or MD too.

In our case, we are having a French drain installed in the basement, which will require digging down through the cement floor. We obviously had to have the removed and abated before the waterproofing work could be done.

Disposal is another issue with removal.

Laws vary by state and locality.

In VA, anyone with anybsense will disclaim, and there is a standard disclaimer form for this purpose. There is no legal requirement to disclose anything in VA.

Try just a flooring company and tell them you want to cover them.

I think if you’re saying “encapsulate” or “remove” you might be triggering like, legal issue avoidance. Just have a flooring company install something over it without asking them to remediate the asbestos.
