Highly possible given the way things are going. Does the other birth parent have legal status?
The EO only applies prospectively. That is, it only applies to babies born 30 days after the order. It doesn't purport to retrospectively strip people of their US citizenship.

He has also followed all immigration steps in hopes of receiving his green card. His kids are U.S. citizens. This is really hard.

This is the part that so many don't understand. So many people think that if you marry a US citizen, you automatically get a green card. That's not true and not how it works. That process can still take years. And becoming a naturalized citizen can take even longer. I know someone who has been working toward that for 7 years now.

Is there any hope that he’ll he released or are they trying to deport everyone they round up? It’s so sad. He has a lawyer but I’m not sure how aggressive they are, and the system is clearly backlogged.
Was he in the country illegally? Does he have a civil or criminal charge or record?
State his visa or citizenship status OP.

Thank you. I feel so badly for his wife and kids who miss him terribly and are very scared.

We have so many people who are working to come to the US the legal way. They are doing the paperwork and paying the fees and waiting.
It angers me that people who come illegally are jumping the line. We should not be rewarding them.

Apparently. There is a daily quota. Contact the media and see if you can get a story out and that ICE is detaining people who are here legally and are not criminals. Use social media.
