Legally, it could make sense, but we need more facts. There are elements of the crime that might not be met and there may be legal defenses that are met.
Involuntary manslaughter.
The person who killed the bystander intentionally shot the gun. Missing your target doesn’t negate the crime. There’s also a tort here.
