Does Elena Kagan know that the US only has 1 national level court? The Federal Courts have circuits for geographic convenience for the parties. Fine if she wants to ask te Judiciary and Congress to change that, but current reality matters.

You'd think a SCOTUS Justice would understand that.

As another poster pointed out, this is in response to a district court restraining order.

Trump has won a bunch of recent victories at the ultimate court - SCOTUS. All these blocks by district judges are just temporary as the suits work their way through the system to SCOTUS. Not sure why people don't understand district courts are just one level of courts.

I'm not the biggest fan of Trump's war on Harvard, at the same time I side with Elena Kagan's 2022 observation that there's something not quite right about the ability of one district court to block a nationwide policy and the way it encourages these kinds of suits to drag out for years to few people's advantages. Trump is testing the courts with his EOs, but so are the district courts themselves.
