What is the difference between disabilities and people of color in terms of what’s acceptable assistance? Neither group can control their disability/color. Both groups are traditionally discriminated against.

Tracking has been a discussion in education for DECADES! It has nothing to do with the current DEI discussion. My mom was a teacher for 38 years and it was a topic 38 years ago.

I think you meant "historically" - there's no "tradition" of discriminating based on disability or skin color. Regardless, focusing on merit alone (rather than discriminating to fix historical injustices) should solve for any discrimination going forward.
