Eh, this is not so cut and dry. Some people like OP believe in the "one drop" rule. I don't. I think black is a color or a set of facial features. I don't think being of African or slave descent necessarily gives you those features so you can be 1/5 African but not be black IMO.

It looks like his grandfather was probably born in Haiti, but genealogists haven't found his birth records from there yet. And his grandmother had old roots in the New Orleans creole community - her mother was baptized in St. Louis Cathedral in the French Quarter in 1840. Lots of people are working on it.

Joseph N. Martinez was recorded as a Black man, born in “Hayti.” His wife, two daughters and an aunt, were also marked “B” in a column denoting “color or race.”

He didn't deny it. He said he didn't know a lot about that side of the family.
His grandfather was from Haiti and his grandmother was black creole.
