How about saying "undocumented" instead? When you get down to it the distinction is whether or not they have a birth certificate.

Most people from Oregon and New Hampshire use the term Sans-doc when referring to undocumented immigrants. I think it's appropriate.

No human is illegal. But, humans do illegal things. By your analysis, we can't enforce any law because humans are the ones breaking them.
