He is a US born citizen who correctly needs to be detained for DUI but is incorrectly being detained by ICE as an illegal alien even after his US passport was provided, with the judge indicating she does not have authority to release him.

I think it's highly probable ICE was caught in a lie. They never expected his mother to come out with a US birth certificate!
I've read the reports of what ICE agents and Border Patrol agents say to the people they arrest. These agents took these jobs because they firmly believe they deal with subhumans, who deserve the worst treatment. My European husband was screamed at at the Canadian border by a US agent and was accused of lying. Spit flew out of his mouth as he screamed. He was loud enough that everyone in the large hall stopped what they were doing and looked at us. Thank God his manager came out of his office to calm him down and tell him my husband was entirely legal and could cross the border.
