Congress passes legislation. The President signs it into law. The courts decide if it's constitutional. It's that last bit that's important here.

You take the good with the bad. Write better laws and the courts won't get involved.

I am hoping so hard that someday we can look back at him the way we look back at Taney. But that assumes the U.S. will survive in any recognizable form.
