Your lease should be clear when rent is due and when it is considered late and late fees will be collected.
It should say rent is due the first day of every month.

What does the lease say? Most standard leases allow a 5-day grace period. I am a landlord and wouldn't evict an otherwise good tenant for paying rent a few days late.

It's due on the 1st but if people don't get charged a late fee until the 5th, what is the incentive to pay ON the 1st? If I get paid on the 5th and I don't get hit with a late fee, I would just pay on the 5th.

See question 10. You can technically move to evict for constantly paying late but I suspect in DC no one would try this given how annoying the process would be.

Op, is it possible your tenant is sending a bank wire on the first of the month and it hits the 3rd? I had a tenant like this - nearly every month a few days late but if all else is good and tenant pays, who cares.

Agreed. Normally the lease specifies the day it’s late.

You would lose more in court costs, legal fees, vacancy (even if it's only vacant a month) than you would recover. And you run the risk they get upset and damage the property.
