Someone once tried to scam us like this. It was complicated by the fact that it was a one-way rental, so we were returning it to a different facility than we'd rented it from.

What the guy who was trying to scam us didn't realize is that we'd just been through a huge ordeal, getting into a car accident while on vacation, an ER visit with our 2 yr old who'd been in the car, having the insurance company deem our car totaled, etc. So we were done being polite and accepting of horrible news, and fought that guy all the way to the corporate division of the company, where we not only were no longer charged for the "damage" (imperceptible "scratches" on the trunk) but also received $100 off a future rental.

You just have to hold firm and not take no for an answer. If they have no proof of the you causing the damage, they can't charge you for it.

You're lucky hertz didnt have you arrested for auto theft, that's been happening to innocent car renters there.

Along with the before and after pics, make sure the after pics include dashboard with overall miles on car as well as fuel level.
