My mom died mid-June 2024 at Brightview, and although we were able to clear the apartment within a week, we had to pay rent for the entire month of July.

Nope. I told them that we could have everything out by the end of June, and they said we will still owe rent through mid July.


You need to give 30 days notice, that’s standard. As soon as you vacate the apartment they can work to re-rent it. If they’re able too you’re off the hook. My moms place had her apartment rented within a few days even though we were on the hook. As soon as they rented it out again our responsibility stopped. So yes, you’re financially responsible for it for a month but you won’t necessarily need to pay the whole extra month if they can rent it out sooner.

Get the stuff out asap and see if they can get it rented. For all you know they could have had it rented by now and you’d have gotten a refund instead of owing though mid-July.


It is not always true that if they are able to re-rent it OP is off the hook. Depends on state law and the lease.

You’re right, although I had told them we planned to (and we had the movers lined up to do so). However, the Brightview Director said we will stay have to pay for 30 days post death.


So you just left the stuff in the apartment? Get the stuff out so they can try to re-rent the place.

Yes. When my mom passed away I had to give them 30 days notice. But when she was in hospice care and they said they were going to stop giving her water, that’s when I said to start the 30 day clock and that shaved about a week off the 30 days.

My dad was at a Cadence facility in Montgomery County. He died on June 1st (a couple of years ago). We had just paid for June. We cleared out his unit within a few days. We got most of June's rent back. I was very surprised.
