This is correct. The "median" was a lane-wide area with yellow stripes. I wasn't able to move into the oncoming lane to pass, and there was no space on the right shoulder.
As long as it’s actual roadway, and not gravel something, in a heartbeat.
The other driver should have pulled over and let you pass though.

If I am on a road and come up to someone doing half the speed limit, I would put my flashers on immediately to help avoid being rear ended by someone coming up behind me.
I would then pass when safe to do so and turn my flashers off after I completed the pass.

I would pass if there were no median and I had a clear view of oncoming (lack of) traffic.
I'm not sure I would pass on the shoulder, if that's what your DH was suggesting. That feels reckless and aggressive in a way that even crossing the yellow line does not. But I would have been quite irritated.

Yes I do it almost weekly where I live.
Safety first. I’d never do it if I don’t have a clear visual.
The rules, or breaking rules, doesn’t always connect right back to safety.
