The behavior in itself isn't concerning to me at all but the context of his causing trouble in the past, plus a commitment by the other parent to supervise, plus your 4yo on his own... I think it's potentially fine to not have him in your sight at all times but I might keep a tighter leash if you know there's a problem kid nearby.
