I’m also a teacher and one concern I have is if we enforce the school policy of masking, because that’s what our administrators tell us to do, a parent could complain to the state that we are violating the EO. The EO specifically states that no teacher will be allowed to require a student to mask. Would the state then go after the teacher for enforcing school district policy?

No. They’re required for those who are “not actively involved” in the practice or athletic event. I personally wear a KN95 the entire time, but I am agreeing with the teacher above that when it’s not required many of the kids don’t wear them.

The state constitution supersedes a state statute, which supersedes an EO. A state statute that is specific also takes precedence over the EO's reference to the unenumerated, vague language in a different state statute. A state statute and EO are subject to judicial review, both in state or federal court. Tennessee had a similar EO. It was challenged in federal court and school districts offering an opt-out were enjoined from implementing them because they infringed on the Constitutionally-protected rights of students with disabilities. Tennessee's state legislature has since passed statewide bans on mask and vaccine mandates but the injunction still holds in Shelby County. The Virginia state senate is still Dem-controlled so a statewide ban will not be happening anytime soon.

I assume you’re trolling or something, but if not you should go see how many kids are wearing masks in PE right now (and how many kids are in the gym during secondary PE). Chances are regardless of what you tell your kids they’ve made up their own minds about what to do at school anyway.

Mainly because the other EO was aligned with local policy. In this instance, they may be in conflict. The first kid who refuses to follow a school rule and says it’s because Governor Youngkin says I don’t have to wear a mask and my parents opted me out can and will be disciplined because you can’t choose what school rules you want to follow. So if a school system or a principal or even a teacher says you will wear masks in this/these school(s) and a kid doesn’t comply, look for them to be disciplined just as if they broke any school rule.

The other EO was not aligned to local policy in 3/4 of the state.
