It is not against any law. These people are illegal immigrants, who Biden let in on parole.
This parole can be revoked at any time, and by dismissing the asylum case, the status returns to as if they just entered the border. This is an expedited removal, and there is very little 'due process' for expedited removals. They can make the same credible fear claim they were using as their excuse when applying for asylum.

Which Democrats understand. Because they don’t want any aliens removed. They want them all registered—to vote.
The judicial process is for Americans.
Immediate deportation is for illegal aliens.
If you break into someone’s house you don’t get to spend months or years debating your presence.
Trespassers must go. And they must go now.
This is indeed what happened, but it’s even worse:
- The backlog for an illegal alien’s very first court appearance is 2 years or longer (about half never even show up).
Then there are the continuances for months or years. Then the appeals, many of which are taking 5 years to come up.
Even after the administrative appeals, there are petitions for review in federal court.
And at any point, the alien can abscond (many do). They are a non-priority, especially in “sanctuary” states and counties.
That is because the Constitution mandates due process for anyone on US soil, regardless of their citizenship or status. Like it or not, deal with it. It's the frickin Constitution.
Now that said, there have been repeated efforts, going back to Obama (and I'm sure prior) to clear the backlog by having more judges and courts and resources to hear and adjudicate the cases to determine whether they should be deported, et cetera. But guess what - it's the Republicans who have staunchly and steadfastly refused to allow any additional funding or resources for that.
Due process for deportations is different than due process for criminal cases.
